Court of Justice of European Union distinguishes between actions brought by shareholders before and after resolution of Banco Popular

As part of a reference for a preliminary ruling, the Spanish Supreme Court is asking the Court of Justice of the European Union (CJEU) about nullity and liability actions brought by shareholders of Banco Popular prior to the resolution in 2017 of the Spanish bank (see EUROPE B11803A9), whose assets were subsequently transferred to Banco Santander (Case C-687/23).

In May 2022 (Case C-410/20) and September 2024 (Cases C-775/22, C-779/22 and C-794/22), the CJEU ruled that the ‘BRRD’...
