EU Council approves conclusion of ‘Mauritius Convention’ on transparency for investor-state disputes

22/05/2025 (Agence Europe)On Thursday 22 May, the Council of the European Union adopted a decision on concluding the United Nations ‘Mauritius Convention’ on transparency for investor-state dispute settlement (ISDS) (see EUROPE 13439/29). This convention provides for the application of international transparency rules to investment treaties signed before 1 April 2014: public access to all documents (judgments, pleadings of the parties) in a case brought before an ISDS dispute settlement tribunal; holding public hearings; and the possibility for third parties to submit a contribution. These rules would affect nearly 1,200 agreements involving EU countries, as well as the EU Energy Charter Treaty (see EUROPE 13644/17). All treaties signed after the beginning of April 2014 automatically include these provisions. (MB)
