19/06/2025 (Agence Europe) – The implementing regulation on the rules for non-tariff criteria for renewable energy auctions by Member States was published in the Official Journal of the EU on Wednesday 18 June. It follows from the obligation set out in the Net-Zero Industry Act (see EUROPE 13344/4) to apply certain non-price criteria as pre-qualification criteria in the design of auctions by Member States. The implementing regulation specifies the pre-qualification or award criteria that should be included in auctions to deploy energy from certain renewable sources “in order to ensure that these criteria are designed and applied in an objective, transparent and non-discriminatory manner, without leading to a disproportionate increase in costs”. It focuses in particular on aspects relating to responsible business conduct, cyber security and commitment to sustainable development and resilience.
