MEPs approve provisional agreement with EU Council on directive harmonising various aspects of insolvency law

11/12/2025 (Agence Europe)On Thursday 11 December, with 20 votes in favour, 3 against and one abstention, MEPs in the Committee on Legal Affairs (JURI) approved the provisional political agreement reached on 19 November between the Parliament and the Council on the directive harmonising various aspects of insolvency law in the EU (see EUROPE 13756/17). This compromise represents a step forward for the Capital Markets Union, while divergences between national regimes still limit cross-border investments. The text establishes common minimum standards to optimise what creditors can recover and make the procedures more efficient. It harmonises the rules allowing certain transactions concluded prior to the start of the procedure to be cancelled in order to prevent creditors from being unduly favoured, improves practitioners’ access to bank registers and registers listing companies’ beneficial owners, standardises the pre-pack mechanism and provides guarantees for workers.
