On Thursday 11 December, the European Commission decided to refer Bulgaria to the Court of Justice of the European Union (CJEU) for failure to transpose the Public Procurement Directive correctly, according to the European Commission.
Sofia currently excludes certain private medical establishments from the scope of the European directive, even when these establishments are more than 50% publicly funded. Since the opening of the infringement procedure in 2019, Bulgaria has submitted amendments but has not yet adopted them.
Furthermore, the Commission considers that the proposed amendments would not be sufficient to bring the situation into full compliance, as some establishments financed by public funds would still not be covered by the Bulgarian law transposing the directive.
This is why the Commission has decided to refer this case to the CJEU. (Original version in French by Léa Marchal)
