15/02/23 (Agence Europe) – On Wednesday 15 February, the European Commission referred Hungary to the EU Court of Justice for contradicting the EU’s position on the recommendations of the World Health Organization (WHO) regarding the inclusion of cannabis and related substances in Council Decision (EU) 2021/3. On 2 December 2020, at the 63rd session of the UN Commission on Narcotic Drugs, Hungary voted twice against the EU position when voting on the WHO recommendations on placing substances under international control. Decisions regarding the international scheduling of substances under the Single Convention on Narcotic Drugs of 1961 and the Convention on Psychotropic Substances of 1971 fall within the exclusive competence of the EU. The EU Council’s decision on the European Union’s position is therefore binding on Member States. (SP)
