11/10/2022 (Agence Europe) – After Austria (see EUROPE 13039/24) and Greenpeace (see EUROPE 13024/5), MEP René Repasi (S&D, German) announced on Monday 10 October that he has filed an appeal with the Court of Justice of the European Union to annul the complementary delegated act that temporarily includes nuclear energy and gas in the EU taxonomy. In his view, the European Commission, unlike the European Parliament, does not have the democratic legitimacy to hold such a political decision. “There has been no individual and enforceable right for Members of Parliament as we know it in German constitutional law. With this action, I want to create a genuine minority right for individual MEPs. This is particularly important when a right-wing majority in the relevant parliamentary committees has prevented the defence of parliamentary rights by the Parliament itself, as in this case”, he argued in a statement.
