Greenpeace takes legal action against European Commission over inclusion of gas and nuclear in EU taxonomy

On Monday 19 September, the NGO Greenpeace announced that it had taken legal action against the European Commission over its decision to include fossil gas and nuclear power in the EU taxonomy.

According to the organisation, this decision (see EUROPE 12991/32) violates not only the EU regulation establishing the taxonomy - a classification system listing economic activities that can be considered environmentally sustainable in order to guide private investors - but also the European Climate Law and the Union’s obligations under the Paris Agreement.

Therefore, the organisation has sent a formal request for an internal review to the Commission, which has a few months (until February) to respond.

If the institution refuses to reverse its decision, Greenpeace will take the case to the Court of Justice of the EU (CJEU), according to the NGO’s statement.

This is in addition to two other similar cases launched by the NGO, challenging the inclusion of bioenergy and bioplastics in the taxonomy (see EUROPE 13023/12).
