On Tuesday 22 July, the European Commission launched the process for adopting a new adequacy decision to allow the free movement of personal data with the United Kingdom.
The aim of the process is to determine whether the country’s data protection framework provides sufficient guarantees under European legislation to allow data to be transferred between the two entities (see EUROPE 13681/37).
As part of the adoption procedure, draft decisions will now be sent to the European Data Protection Board for its opinion. The EU Council and the European Parliament also have a say in the final decision.
In June 2025, the Commission adopted a six-month technical extension to the two dated adequacy decisions to assess the UK’s Data Use and Access Act, promulgated on 19 June.
The act sets out new rules on automated data processing and the structure of the UK’s data protection authority. The new draft decisions are based on an assessment of these new rules. (Original version in French by Isalia Stieffatre)
