18/06/25 (Agence Europe) – On Wednesday 18 June, the European Commission announced that it was taking Germany to the European Court of Justice for incorrectly transposing two European directives on public procurement. Berlin does not comply with the rules on access to information for candidates for public procurement contracts who wish to request a review of the decision taken by the contracting authorities. In addition, German law is not sufficiently clear on the definition of ‘contracting entity’ and this complicates the selection of the appropriate procedure. Finally, Germany exempts the postal sector from the rules on public procurement, which is not in line with Community rules, according to the Commission. The letter of formal notice sent in 2019, followed by the reasoned opinion in 2021, were not enough to ensure that Berlin complied with EU rules. (LM)
