Bulgaria, Ireland and Portugal referred to CJEU by Commission for failure to correctly transpose regulation on removal of terrorist content online

On Wednesday 18 June, the European Commission referred Bulgaria, Ireland and Portugal to the Court of Justice of the EU for failure to comply with the Terrorist Content Online (TCO) Regulation, it announced in a press release (see EUROPE 12709/2).

The regulation, which came into force on 7 June 2022, requires online platforms to take down terrorist content in the EU within one hour of receiving a removal order from Member State authorities. This is to prevent attacks and combat radicalisation.

These countries have “failed to comply with one or more obligations under the TCO Regulation. This includes the requirement: - to designate the authority or authorities responsible for enforcing the Regulation and ensuring compliance, and to notify the Commission of those authorities; - to establish a public contact point to handle requests for clarification and feedback in relation to removal orders; - to lay down the rules and measures on penalties in case of non-compliance of hosting service providers with their legal obligations.”.
