The European Commission published, on Thursday 23 February, a proposal for a regulation to extend the autonomous trade measures it took in June 2022 against Ukraine (see EUROPE 12965/11, 12940/3). These abolish the tariffs and quotas that still exist for Ukraine’s exports to the EU. The Commission thus proposes to extend until June 2024 the measures expiring in June 2023.
This time it adds a safeguard mechanism in the regulation “to protect the Union market, if necessary”. The Commission retains the right to adopt an implementing regulation to reintroduce customs duties (in line with those of the EU/Ukraine Association Agreement) in the event that a Ukrainian product is imported under conditions that adversely affect the EU market.
The Regulation therefore provides for increased monitoring of trade and its impact.
It must now be examined by the European Parliament and the Member States for approval so that it can enter into force on 6 June 2023.
