Uncertainties remain in EU Council on deployment of cooperative intelligent transport systems

The meeting of the working party on Transport - Intermodal Questions and Networks of the Council of the European Union on 26 June did not, as we had announced (see EUROPE 12283/28), provide clarity on the position of Member States on the delegated regulation on the deployment of cooperative intelligent transport systems (C-ITS), while a decisive meeting of Member States' ambassadors to the European Union (Committee of the Permanent Representatives - Coreper) will be held on 4 July.

This discussion, which concerned the delegated act presented last March by the European Commission (see EUROPE 12213/37), echoed the publication on 14 June by the EU Council's Legal Service of an opinion in which it highlighted certain shortcomings in the text (see EUROPE 12276/14).

While the EU Council and the European Parliament have in principle two months to approve or object to such an act, the legal doubts expressed by several national delegations led, in May, to a postponement of the decision by two months to the EU Council (see EUROPE 12253/29).

According to our information, at this last working party meeting on 26 June, only three delegations clearly reaffirmed their support for the delegated regulation, while eight of them expressed their unambiguous opposition. Eight other delegations reportedly expressed doubts, and it seems that the other Member States did not take the floor.

As a new development, France has now expressed its opposition to the act, while the German position still does not seem to be settled.

For the act to be subject to an objection in the EU Council, a majority of 21 Member States representing 65% of the population is required. The final scenario therefore does not seem clear. Coreper will meet on Thursday 4 July to take a position on this matter.
