30/01/26 (Agence Europe) – On Friday 30 January, the European Commission decided to send a letter of formal notice to Poland, taking the view that this Member State has not complied with the judgment (https://aeur.eu/f/ki7 ) of the Court of Justice of the EU of 2 March 2023 (see EUROPE 13133/23). The Court found that Poland had failed to fulfil its obligations under the Habitats Directive (Directive 92/43/EEC), the Charter of Fundamental Rights of the European Union and the Aarhus Convention. At issue: the lack of guarantees enabling environmental organisations to challenge, before national courts, the material and procedural shortcomings of forest management plans likely to have an impact on Natura 2000 sites. Poland has two months to remedy these shortcomings, failing which the Commission may decide to refer the matter to the Court of Justice and request the imposition of financial penalties. (LC)
