At the time of writing, the Council of the EU and the European Parliament were starting political discussions on the ‘REPowerEU’ regulation as part of the second round of their trilogue negotiations as co-legislators on the dossier on Thursday 20 November.
The two institutions have yet to decide on the final date for banning all imports of Russian gas into the EU. The Council of the EU wants to keep the date of 1 January 2028, as proposed by the European Commission, while the Parliament is aiming for 1 January 2027, for both gas imported by pipeline and liquefied natural gas (LNG), which is now covered by the EU sanctions regime.
Negotiators were due to discuss the progress made on the information requested from customs authorities (https://aeur.eu/f/jki ). They were also due to discuss the penalty system for non-compliance with the regulation, probably rejecting the Parliament’s proposal for a fine of up to 5% of the annual worldwide turnover of a company concerned (see EUROPE 13753/6).
The co-legislators also continued negotiations on the revision clause for the ban, in the event of risks to security of supply, the inclusion of a ban on Russian oil imports, as called for by Parliament, and national diversification plans.
