The Irish Data Protection Commission (DPC), which acts on behalf of the European Union, announced, on Friday 11 April, that it was opening an investigation into the social network X and its processing of the data of its European users to train its ‘Grok’ generative artificial intelligence model.
The DPC’s investigation must determine whether the platform has breached several provisions of the General Data Protection Regulation (GDPR), particularly with regard to the legality and transparency of processing.
The social network, owned by Elon Musk, had announced that it would suspend the training of its AI with European data in September 2024 (see EUROPE 13475/13), after several complaints.
In December, the European Data Protection Board (EDPB) issued an opinion in which it did not really oppose the use of European users’ data to train artificial intelligence models, arguing that “the legitimate interest argument can be a legal basis for justification” (see EUROPE 13549/10).
The DPC does not specify whether the opening of its investigation follows a change in policy on the part of X. (Original version in French by Isalia Stieffatre)
