Several Member States wish to include penalty point systems in directive on driving disqualifications

On Tuesday 18 June, EU Transport Ministers meeting in Luxembourg approved without debate the progress report on the draft directive on the effect, at EU level, of certain driving disqualifications (see EUROPE 13430/11).

According to the report, several Member States are asking for the scope of the directive to include penalty point systems, as in several countries certain serious offences, such as speeding, do not lead directly to a disqualification decision. Forfeiture is decided only when a certain threshold of penalty points is reached.

Some Member States would like to include other types of offence in the scope of application, such as a driver’s refusal to submit to alcohol or drug tests or driving without a licence. In addition, some delegations felt that the mutual recognition mechanism should apply to both driving licences and driving rights. It is therefore important to ensure consistency between this directive and the directive on driving licences, which is currently being revised (see EUROPE 13360/9).

In addition, the Member States still have questions about the distinction between the different types of disqualification and how they fit into their national systems. For example, in some Member States, a licence cannot be withdrawn, only suspended. These discussions will continue under the Hungarian Presidency, which begins on Monday 1 July.
