European Commission opens public consultation on targeted amendment to agricultural de minimis regulation

On Friday 7 June, the European Commission announced that it was launching a public consultation of interested parties on a draft targeted amendment to the rules on small amounts of aid to the agricultural sector, also known as the “agricultural de minimis regulation”.

The de minimis regulation currently in force is due to expire on 31 December 2027, and a revision was planned. It has been brought forward and, in view of sustained inflation (see EUROPE 13401/1), work on a targeted revision was launched by the European Commission on 2 May.

The proposed changes include raising the maximum de minimis cap per company over 3 years from €25,000 to €37,000 and adjusting the ‘national caps’.

The calculation of the maximum amount of aid should also be changed to a three-year period, instead of three fiscal years.

Finally, in the interests of transparency and reducing the administrative burden, the introduction of a compulsory central register of de minimis aid at national or European level is envisaged. Central registers are currently optional for Member States.
