28/10/2021 (Agence Europe) – As work continues on the Digital Markets Area (DMA) legislation (see EUROPE 12821/8), eight leading e-commerce companies called on Wednesday 27 October for a review of the definition of ‘end user’ under the DMA. Specifically, Booking.com, Zalando, bol.com, Allegro, eMag, Delivery Hero, Vinted and Wolt believe that not all visitors to their sites become customers and therefore fear that they are at a disadvantage compared to other platforms. These digital players point out that the majority of their income is derived from sales and that these cannot be associated with mere ‘visitors’. In a joint letter, the eight companies said they were “alarmed” by the current discussions and insisted in particular on the need to reconsider the methods for calculating the number of users. (TM)
