Portugal must not dissuade citizens from buying property in another Member State

Brussels, 19.07.2004 (Agence Europe) - The European Commission has sent Portugal a formal request to amend its legislation regarding capital gains from home sales. The legislation does not allow tax relief for capital gains unless such profits are re-invested in the purchase of property in Portugal. According to the Commission, this provision creates an obstacle to the free movement of persons in so far as it discourages Portuguese nationals from selling their property in order to buy a home...
