Noyb believes European Commission is jeopardising fundamental rights of European citizens with its omnibus on digital technology

The Austrian association Noyb has joined forces with the EDRi and the Irish Council for Civil Liberties (ICCL) to co-sign an open letter to the European Commission, in which they criticise possible future changes to the European General Data Protection Regulation (GDPR).

The three privacy protection associations maintain that the targeted reopening, as presented today by the latest version of the omnibus legislation to simplify digital regulation (see EUROPE 13747/1), is a “potential threat to the fundamental rights of Europeans”.

Instead of the targeted adjustments announced, the European Commission is proposing changes to fundamental elements, such as re-defining what constitutes personal data and the rights of data subjects under the GDPR. The leaked working version also suggests giving AI companies free reign to collect personal data”, worry the signatories.

The three organisations criticise the lack of consultation and impact assessments. In their view, the Commission now appears to “plan substantive changes to key EU laws, potentially in conflict with the Charter of Fundamental Rights, without following its own Better Regulation principles”.

They are calling on the institution to “reconsider” its approach to the digital omnibus. Noyb has also published a full and detailed analysis of the changes made to GDPR by the latest working version of the digital omnibus.
