In a new report published on Monday 13 October, the NGOs Médecins du Monde and PICUM, which defend undocumented migrants, warned that the new European regulation on migration could jeopardise healthcare.
The regulation “facilitates the collection and access of third country nationals’ data, including information on vulnerability, health and medical needs between EU Member States and between Member States and third countries for the purpose of implementing expulsion operations”.
Decisions on “transferring personal data, including sensitive data on the health of third-country nationals, are left to the national authorities and, where relevant, Frontex (...). There is no mention of independent medical professionals, data protection authorities or judicial oversight in assessing the risks or justifying the data transfer”.
This is in direct contradiction with Article 8 of the EU Charter of Fundamental Rights and the General Data Protection Regulation, add the NGOs, who are calling on legislators to reject the regulation.
