European Commission consults on revision of rescue and restructuring aid guidelines

From 22 August to 14 November, the European Commission launched a call for evidence and a public consultation on the revision of the guidelines on State aid for rescuing and restructuring firms in difficulty.

These contributions will be used to update these guidelines to ensure that they remain fit for purpose.

The Commission proposes: - to extend the scope of the guidelines to include the steel sector, which is currently excluded (the sector was excluded from the scope of the guidelines in 2014 due to overcapacity at EU and global level); - to amend the definition of ‘firm in difficulty’ with regard to certain types of innovative ‘start-ups’ which have a specific growth model, thus enabling them to benefit from aid under other State aid instruments; - to clarify certain parts of the definition of a company in difficulty, in particular the concept of ‘own funds’ and its relationship with equity capital and the solvency of companies in difficulty.
