EU Court of Justice clarifies conditions enabling concession contracts to be modified without call for competition

In Germany between 1996 and 1998, the State awarded 280 concession contracts for the operation of service areas on federal motorways for a maximum period of 40 years to Tank & Rast, a company that it wholly owned at the time the contract was awarded but that it has since privatised.
