Malta’s citizenship by investment programme is contrary to EU law, says Court of Justice

Commercialising the nationality of a European Union Member State, and therefore European citizenship, is incompatible with the Treaties, ruled the Court of Justice of the European Union (CJEU) in a judgment handed down on Tuesday 29 April (case C-181/23).

The European Commission is challenging at the Court of Justice a Maltese regulation from 2020 which grants naturalisation in return for predetermined payments or investments to persons with no real link with Malta (see EUROPE B13032A23)....
