European Commission publishes its second report on implementation of GDPR

Four years after the publication of its first report, on Thursday 25 July the European Commission published its second assessment of the application of the General Data Protection Regulation (GDPR).

This second study shows that the implementation of the GDPR has been a success overall, with “a broad consensus” on the “significant results” of the regulation for “businesses and individuals”.

Presented as “the cornerstone for the panoply of initiatives that are helping to drive the digital transition in the EU”, the regulation can continue to be developed. The report points to a number of areas for improvement, starting with the development of international procedures.

The flow of data between countries, while improving cooperation in terms of security and commercial development, is crucial to the smooth operation of the GDPR. The inclusion of data protection guarantees is not only “a precondition for trade”, but also “a vector for deeper cooperation”.

On this point, the report considers that the EU would benefit from “expanding” the tools enabling the application and operation of the international transfer of personal data to third countries and strengthening the control mechanisms.

Similarly, the application of the GDPR to players with more limited resources would benefit from closer study by the Commission.

Again according to the report, it could “propose guidelines and tailor-made tools” adapted to the problems identified, such as diverging interpretations of the GDPR between national authorities.
