On Friday 14 July, the European Commission adopted the 2022 edition of its annual report on monitoring the application of EU law.
In 2022, the European Commission opened 551 new infringement proceedings. All Member States were concerned by the opening of new infringement proceedings, and solutions were found before action was brought before the Court of Justice of the European Union (CJEU) in 96% of cases.
Appeals were lodged with the CJEU in 35 cases, compared with 31 the previous year with 17 related to the late transposition of directives. The Commission has requested financial penalties to encourage the Member States concerned to speed up their compliance. In addition, 489 infringement proceedings were closed in 2022.
The Commission has also continued to make use of the dialogue with Member States before any infringement proceedings through the ‘EU Pilot’ procedure. Some 279 files were opened in 2022, compared with 246 in 2021. The Commission said that nearly 74% of the cases handled in 2022 resulted in a solution.
Finally, the Commission has also indicated that the percentage of single market directives whose full transposition has not yet been notified to the Commission has fallen to 1.1%, compared with 1.6% in 2021. The percentage of incorrect transposition of single market directives remained stable in 2022 at 1.3%. (Original version in French by Thomas Mangin)
