14/05/2002 (Agence Europe) - Commission Spokesman Jonathan Faull announced on Tuesday that the Commission had decided not to take action before the Court of Justice against the Council's decision concerning aid to Italian, French and Dutch hauliers. On 3 May, the Council had decided these measures were to be considered aid compatible with the Treaty (see EUROPE of 4 May, p.11), a decision which blocked the negative decision that the Commission was preparing to take. While regretting that it had thus been "short-circuited" by the Council, the Commission decided not to initiate proceedings against the political and legal arguments put forward, Commissioner de Palacio's spokesperson comments. Jonathan Faull, also noted the Council gave its assurance that this decision would not be a precedent.
