In two judgments handed down on Wednesday 10 September (cases T-55/24 and T-58/24), the General Court of the European Union has annulled the European Commission’s implementing decisions determining the supervisory fee payable for 2023 by Facebook, Instagram and TikTok under the Digital Services Act (DSA). However, the companies will still be required to pay the fee for 2023, pending the Commission’s correction of its ‘level 2’ regulations to bring them into line with the DSA.
