EU Court of Justice rules withdrawal of cases from a judge must be “justified” and based on “objective and precise criteria

In a ruling handed down on Thursday 6 March in joined cases C-647/21 and C-648/21 concerning the withdrawal of cases from a judge, the Court of Justice of the EU (CJEU) stated that such a decision must be based on “objective and precise criteria”. 

The aim is to ensure judicial independence and avoid any interference in national jurisdictions.
