Public consultation on draft ban on bisphenol A in food contact materials

The European Commission is preparing a regulation to ban bisphenol A (BPA) in food contact materials, for adoption in the first quarter of 2024. It is seeking the views of all interested parties via an online public consultation open until midnight on 8 March.

The Commission’s draft regulation is based on the reassessment of the public health risks of BPA by the European Food Safety Authority (EFSA), which concluded that current levels of exposure to BPA pose health concerns for consumers in all age groups (see EUROPE 13165/22).

The proposed ban will apply in particular to food and drink cans, but also to kitchen utensils, crockery and articles in contact with food used in professional food production.

Once the ban has been agreed with the Member States and adopted by the Commission, certain transitional periods will apply after its entry into force to give industry time to adapt.

The length of these transitional periods will depend on the product. The feedback mechanism will be followed by a discussion and vote by the Member States.

This future regulation will repeal European Commission regulation (EU) 2018/213.
