13/02/2024 (Agence Europe) – On Tuesday 13 February, the European Commission announced that it had finalised its in-depth investigation launched in February 2019 following the partial annulment by the EU General Court of one of its decisions authorising support from Sweden and Denmark for the Øresund fixed rail-road link (see EUROPE 12204/26). The Commission concluded that the State guarantee model granted by Denmark and Sweden for the construction of the Øresund link did not constitute new aid and that its conformity no longer needed to be examined. However, the Commission also concluded that the special tax aid implemented by Denmark partly constituted new aid, and that this aid, for certain periods, was disproportionate and therefore incompatible with European rules. Consequently, Denmark will have to recover the incompatible aid and interest without delay. (EV)
