12/12/2023 (Agence Europe) – On the evening of Monday 11 December, the European Commission announced that it had taken note of the Polish Constitutional Tribunal’s decision of the same day to rule that the fines imposed by the EU for non-compliance with the provisional rulings of the European Court of Justice were unconstitutional. “We have taken note of today’s decision by the Polish Constitutional Tribunal, which adds to the concerns previously expressed by the Commission about the Tribunal and its case law”, said spokesman Christian Wigand. “The Commission has always been very clear on this issue and reaffirms it once again: Community law takes precedence over national law; all decisions of the European Court of Justice, including orders for interim measures or financial penalties, are binding on the national authorities and courts of all Member States”.
