there will be no compromise under Swedish Presidency” of EU Council regarding digitalisation of judicial cooperation, says European Parliament rapporteur Emil Radev

There is no real willingness to compromise on the part of the Council”. Heard on 30 May by the European Parliament’s Committee on Legal Affairs (JURI) on the occasion of its report following the inter-institutional negotiations on the regulation on the digitalisation of judicial cooperation and access to justice (see EUROPE 12844/12) held on 25 May (see EUROPE 13189/2), MEP Emil Radev (EPP, Bulgarian) announced that there would be “no compromise under the Swedish Presidency”.

And with good reason: according to the text’s rapporteur, the European Parliament has taken a step forward in reaching a consensus on the points debated, but the MEPs are “still waiting for the Presidency’s response”.

Among the issues raised, Mr Radev set out a series of “very specific political questions”: the inclusion of national computer portals in the scope of application, the possibility of using videoconferencing in civil proceedings, and the “availability of this technology in the judicial structure of the Member States”.

There would also have been discussion of the elements highlighted in Article 8 on safety, public health and the use of implementing acts and delegated acts, as well as the deadlines for the adoption of these acts and the implementation of the regulation.

In addition, several technical meetings were held. “The last one was held on 26 May”, said the Bulgarian MEP. He added: “For the moment, negotiations are continuing and making progress, but it’s not that simple”. (Original version in French by Nithya Paquiry)
