Revision of ETS, new draft compromise of French Presidency of EU Council

On Monday 30 May, the French Presidency of the Council of the European Union sent Member States a new draft compromise on the revision of the EU Emissions Trading System (ETS).

The document contains few new features compared to the previous version detailed in our lines (see EUROPE 12960/10).

Thus, the bulk of the new amendments do not relate to the Directive (2003/87) establishing the ETS, but to the Regulation (2015/757) on the monitoring, reporting and verification of CO2 emissions from the maritime transport sector in order to take into account the inclusion of this sector in the ETS.

In particular, the French Presidency suggests that the European Commission should review the regulation by 31 December 2025 at the latest, in order to assess the appropriateness of including in its scope ships with a gross tonnage of between 400 and 5,000 with a view to their possible inclusion in the ETS at a later date.

It also wants the Commission to assess, every two years, the overall impact of the maritime transport sector on the global climate, including through emissions of greenhouse gases other than CO2.

As in previous versions, the new draft compromise does not address the part of the text on the establishment of a second ETS covering emissions from heating of buildings and road transport (ETS2), the most divisive element of this dossier.

For its part, the European Parliament is due to adopt its position on the ETS review (including the part on ETS2) next Wednesday (8 June - see other news).
