Conciliation procedure on Rome II gets blocked

Brussels, 21/03/2007 (Agence Europe) - The Council of the EU and Parliament will still have to get over a final barrier if they want to reach a definitive agreement on the draft regulation on the law on non-contractual obligations (Rome II). The main problem confronting most member states closely involves competition law, particularly the possibility for consumers who are the victims of damages to go to court in a simplified and efficient way against cartels Currently the common position stipulates that the law in the even to f non-respect of non-contractual obligations is the law of where the damages arose. If damages are imputed to a cartel occurs in several member states, the judge could be confronted by very different laws. This is why the Commission, supported by the Parliament, is in favour of the application of a single law for all damages. Member states are sceptical. One diplomatic source said that, “this proposal is late, whereas negotiations have been ongoing for almost two years”. he also affirmed that there was a real risk of reopening a Pandora's boss and threatening the definitive adoption of the draft regulation. The next Trialogue between the presidency, EP and Commission is on 27 March. Conciliation is planned for 15 May. (bc)
