Germany and two broadcasters challenge Commission's decision on aid for hertzian digital television

Luxembourg, 19/04/2006 (Agence Europe) - Germany and two private broadcasters, FAB Fernsehen aus Berlin and Medienanstalt Berlin-Brandenburg, are calling on the European Court of First Instance to cancel the European Commission's decision of 9 November 2005 which considers as illegal any State aid to broadcasters participating in hertzian digital television in the Land of Berlin-Brandenburg. In its decision (see EUROPE 9066), the Commission had ordered Germany to recover aid already given.

All consider that errors of law have been made by the European Commission. Germany notes errors of appreciation and judgement on the part of the Commission. If there was indeed aid, it was compatible with EU law, the companies say.
