29/04/2026 (Agence Europe) – On Wednesday 29 April, the European Commission decided to take the Czech Republic and Hungary to the Court of Justice of the EU for incorrect transposition of the Framework Decision on the European Arrest Warrant (2002/584/JHA). It sent an initial letter of formal notice to the Czech Republic in December 2020 and to Hungary in June 2021. The Commission maintains that Czech law does not guarantee either the temporary transfer of the requested person to the issuing Member State or their hearing in the executing Member State pending the decision on their extradition. And it does not guarantee that the duration of the temporary transfer will be determined by mutual agreement between the issuing judicial authority and the executing judicial authority. Hungarian law incorrectly transposes the provisions relating to grounds for refusal, obliging the judicial authorities to refuse requests for European Arrest Warrants for certain offences which are not criminalised in Hungary.
