The European Parliament is contesting the European Commission’s withdrawal of the draft regulation on standard-essential patents (SEPs). On Tuesday 25 November, a majority of MEPs (334 in favour, 294 against, 11 abstentions) followed the lead of the Committee on Legal Affairs (JURI), which called for a referral to the Court of Justice of the EU (CJEU) (see EUROPE 13755/32). The procedure was launched back in November and the case is now before the CJEU. In recent months, MEPs had accused the Commission of ignoring the European Parliament’s opinion by withdrawing the proposal and setting an undemocratic precedent. (LM)
