On Wednesday 21 May, the Member States’ ambassadors to the EU gave the green light to the ‘omnibus’ regulation amending the Carbon Border Adjustment Mechanism (CBAM) (see EUROPE 13588/4). The European Affairs Ministers are due to formally adopt this negotiating position at the General Affairs Council on 27 May.
In recent weeks, the Member States have made a number of comments which have been taken into account in the final compromise. These are minor technical changes.
The Council also wishes to give the Commission the power to amend again, if necessary in the future and by delegated act, the import threshold above which CBAM applies.
Given that the positions of the Council and the European Parliament are fairly close, the Polish Presidency of the Council of the EU even hopes to conclude negotiations with the European Parliament during the month of June.
