Court of Justice refers a case concerning importation into EU of ammonium nitrate from Russia to General Court

30/04/2025 (Agence Europe)The Court of Justice of the European Union has annulled the judgment of the General Court of the EU of July 2023, which had itself annulled the Regulation (2020/2100) introducing a definitive anti-dumping duty on imports into the EU of ammonium nitrate originating in Russia (Case T-126/21 - see EUROPE 13216/18), in a judgment delivered on Wednesday 30 April (joined Cases C-554/23 P and C-568/23). According to the Court of Justice, the General Court erred in law by holding that the Commission, when examining whether there was sufficient evidence to initiate an expiry review of anti-dumping measures, could rely solely on a request for a review submitted by EU producers within the statutory period. The case is referred back to the General Court.
