05/07/2023 (Agence Europe) – On Wednesday 5 July, the General Court of the European Union upheld the appeal lodged by two Russian companies and annulled the European Commission’s implementing regulation (2020/2100) of December 2020 that imposed a definitive anti-dumping duty on imports into the EU of ammonium nitrate originating in Russia (Case T-126/21) (see EUROPE 12345/19). In particular, it is of the opinion that the European Commission erred in law when it stated that it was not appropriate to supplement the request by the European fertiliser manufacturers’ association, Fertilizers Europe, to extend the anti-dumping duties with additional information that was provided by the two Russian companies.
