16/12/2024 (Agence Europe) – On Monday 16 December, the European Commission referred Spain to the EU Court of Justice (CJEU) in the infringement proceedings launched against it for failure to comply with the public procurement directives. Spain has still not introduced the necessary changes to its national law to make it compatible with the European directives, according to the Commission. The Spanish rules still differ from the European ones in terms of scope, both in terms of the type of contracts and the contracting authorities involved. The Commission considers that the letter of formal notice, followed by the reasoned opinion sent to Spain in 2021 and 2024, failed to remedy the situation. It is therefore bringing the case before the CJEU. (LM)
