06/09/2023 (Agence Europe) – On Wednesday 6 September, the General Court of the European Union annulled EU Council Decisions (2022/1530 and 2023/572) and the implementing Regulation (2023/571) insofar as the name of the oligarch Aleksandr Aleksandrovich Shulgin, CEO of the Ozon e-commerce platform, was maintained on the list of persons and entities sanctioned by the EU (Case T-364/22). It accepts the plea put forward by Mr Shulgin’s defence alleging a manifest error of assessment by the EU Conseil. According to the General Court, the EU Council did not provide sufficient evidence that Mr Shulgin remained an influential businessman in economic sectors which constitute a substantial source of revenue for the Russian State, inasmuch as he had resigned from any position within the Ozon Group before the adoption of the legislative texts which kept him on the list of Russian oligarchs sanctioned by the EU.
