September will be used by the European Parliament, the Council of the EU and the European Commission to make technical progress in their tripartite negotiations (trilogues) on revising the Industrial Emissions Directive 2010/75/EU (IED) and establishing the emissions portal, before continuing the political negotiations at the beginning of October.
The Member States’ ambassadors to the EU (Coreper) were informed of this on Wednesday 6 September by the Spanish Presidency of the Council, which hopes to be able to complete these dossiers before the end of the year, with the same timetable for both texts.
The second trilogue will be held on 3 October. A potential date for a third trilogue would be 28 November, “to complete the negotiations”, according to a source close to the dossier.
This legislative package was presented in April 2022 to strengthen the directive, and to facilitate the transition to the circular economy by 2030 and the ambition of zero toxic pollution of water, air and soil in the EU by 2050 (see EUROPE 12926/2).
As a reminder, the part of the directive concerning livestock farming - the inclusion of large farms and the livestock unit (LU) thresholds above which the future revised directive would apply - has given the Parliament and the Council a hard time, with both deeming the Commission’s proposal too ambitious.
At the first trilogue on 19 July, the negotiators simply presented their respective positions, as is customary. The Commission reiterated that its proposal did not apply to small farms.
The European Parliament voted on 11 July to exclude cattle farming from the scope of the directive (see EUROPE 13220/4). The Council adopted its position (‘general approach’) in March (see EUROPE 13143/6).
With regard to the future Emissions Portal (replacing the current Pollutant Release and Transfer Register) for the transparency of environmental data from industrial sites (see EUROPE 13196/6), the negotiations should not raise any major political problems.
