27/06/2023 (Agence Europe) – On Monday 26 June, the European Court of Human Rights rejected the request to refer a judgment that did not condemn France for refusing to use the term “gender neutral” or “intersex” back to the Grand Chamber. This judgment, handed down in January 2023, is therefore final. It concerns a biologically intersex person requesting an amendment to their birth certificate. The Court acknowledged the applicant’s suffering, but emphasised the “special weight” to be given to the role of the national decision-maker in cases involving societal issues that entail a change in domestic law. “In the absence of a European consensus in this area”, it states, “it was therefore appropriate to leave it to the respondent State to determine at what speed and to what extent it could meet the demands of intersex persons”.
