Data Act’, Global Data Alliance concerned about unclear rules on access to non-personal data

03/05/2023 (Agence Europe)The Global Data Alliance (GDA), led by the multi-sectoral Business Software Alliance, highlighted its concerns about certain aspects of the forthcoming ‘Data Act’ to the EU co-legislators (Council of the EU and European Parliament) on Tuesday 2 May (see EUROPE 13150/7). In particular, the GDA believes that Article 27, which is to establish safeguards against unlawful access by third parties to non-personal data held in the EU, should be clarified. In particular, it is concerned about the lack of examination of the impact of certain restrictions on the transfer of non-personal data and of location requirements. It also deplores the “failure of the EU to justify the treatment of non-personal data as sensitive in the same way as personal data” and the “lack of clarity in the rules for businesses”. (TM)
