06/12/2022 (Agence Europe) – The European Data Protection Board (EDPB) on Tuesday 6 December adopted three decisions aimed at settling disputes between several national supervisory authorities and the Irish authority regarding the latter’s draft decisions against Facebook, WhatsApp and Instagram. All three are part of the Meta group. These decisions of the EDPB thus aim to settle the question of whether or not the processing of personal data for the performance of a contract constitutes an “appropriate legal basis” for behavioural advertising, in the case of Facebook and Instagram, and for service improvement, in the case of WhatsApp. The Irish Authority should therefore adopt its three final decisions, taking into account the EDPB’s legal assessment, no later than one month after the EDPB has notified its decisions.
