Machinery products, European Parliament and EU Council will hold another interinstitutional meeting on 15 December

The European Parliament and the Council of the EU will meet for a third time to discuss the machinery products regulation on Thursday 15 December, according to our information.

The Czech Presidency of the EU Council has submitted a new mandate to the national delegations to resume negotiations with the European Parliament in mid-December, which is expected to be discussed tomorrow in the framework of the Committee of Permanent Representatives I (Coreper I).

At the second interinstitutional meeting on 17 November, the co-legislators were able to reach a compromise on terminology, the main principles of the digital and paper instructions to be provided by manufacturers and the fees for SMEs for conformity assessment (see EUROPE 13066/4).

However, the transitional provisions, the date of application, the content of Annex I and Article 5, which empowers the Commission to amend Annex I for high-risk machinery, have not been resolved and will require a compromise solution from both co-legislators at the next trilogue, says the Czech Presidency of the EU Council in its negotiation preparation document.

On Article 5, the Presidency proposes to give the Commission the power to adopt the method of data collection by means of a delegated act, but only in the case where the data provided by the Member States within 24 months of the date of entry into force of the Regulation is considered by the Commission to be insufficient. In other words “this means that the Commission would not be able to trigger its empowerment automatically but needs to justify the need to adopt the methodology for collecting data”. The other main point concerns the list of categories of machinery in Annex I subject to a conformity assessment obligation.

Thus, the Presidency will seek to sound out delegations on the scope of the number of categories included in Annex I and the methodology for collecting the data.
