03/10/2022 (Agence Europe) – On Monday 3 October, the European Commission opened a consultation period on its proposal for a Directive on liability for artificial intelligence (AI). As a reminder, this text, which was unveiled by the European Commission on 28 September (see EUROPE 13031/10), should facilitate access to redress for users of AI systems who suffer damage, whereas current product rules ensure that producers compensate consumers for damage caused by defective products. In addition to “addressing challenges brought about by AI”, this initiative thus aims, in the context of the transition to a circular and digital economy, to adapt the existing liability framework for damage caused by new or refurbished products to technological developments.
